Hausbesetzung

EKH-Newsletter, 12 December 2004 (english)

Translated into english from german.
+++

For clarification: It is right that some groups using the house with a precarious tenancy agreement (not really a hiring contract) have drawn a compromise with the new property management. The following scopes are affected: The Marxian Center, the umbrella organization of Serbian and Yugoslavian associations, the rooms of ATIGF, the refugee area in the 2nd floor as well as the whole 4th floor.

That means the owner of the precarious tenancy agreement abandon the use of any appeal and should leave their premises within June 30th 2004.

The new property management exerted massiv pressure juridical as well as financial on the approved signatories to force them signing the compromise, among other things with a doubtful transfer of outstanding depts from the Austrian Communist Party (KPÖ) to the new property management. In case of denial the signing the affected groups should have had to pay 3 Euro / sqm additional to the overheads. This claim, the affected groups, couldn't and did not want to accomplish because their non-profit character.

The approach of the persons involved is not in the same tenor as our jurdical strategy. The remaining scopes, partially with hiring contracts (3rd floor and the event area), have not signed the compromise and will continue to use all available legal means against a possible eviction.

The visit of the "Bureau for immediate action" (Büro für Sofortmaßnahmen) of the vienna magistrate, as announced in our last newsletter, is still outstanding. It is still demanded that we remove all deposits from the corridor (eg. our kitchens, oven and bureau). If and when this actions are enforced is still unclear, but we assume, it could be anytime.

Some thoughts on the demonstration 12th of December 2004: From our point of view the demonstration worked well, because the x-mas consuming terror was disturbed by about 1000 riot-cops. We also look positivly upon the ressonance of the mainstream media. Why the demonstration remained a standing manifestation we wrote in our last newsletter. We didn't want to be exploited in the sense of the system. Anyhow we think that our intern communication did not work perfechtly, which caused confusion and wrong rumours. Also in the preparation some things went wrong. We hope that in future more people will participate proactive and make further actions more alive.
